Applicant understands that, in consideration of this Application and Agreement to Lease, Landlord has taken a rental apartment off the market and reserved it specifically for Applicant pending the processing of this Application, unless the Application is rejected, pending the execution and return of all lease documents. This deposit paid by Applicant will be held in escrow as a security deposit until such time as the lease is terminated and the apartment is vacated. The cost of necessary cleaning, repairs, or replacements shall be deducted from the security deposit at termination of the lease. Under no circumstances will this deposit be considered as part of the rent. This is a legally binding offer to enter into a Joint and Several lease for the premises on Landlord's current form containing the above. Landlord may accept this offer by mailing a confirmation to my permanent address or giving it to me in person. If Landlord accepts, I agree to sign this lease. If I try to withdraw this offer after acceptance, or if I fail to sign, Landlord will try to relet the premises for me. However, until Landlord is successful, I must pay the rent and perform all other obligations in the lease, whether I have signed or not. If Landlord is successful, Landlord shall keep my security deposit and any pre-paid rent as liquidated damages for processing this application and holding the premises for me. I hereby agree to abide by the entire Lease Agreement. If my income or credit history is not sufficient, I understand that I will be required to have a qualified guarantor who will guarantee my rent payments and all other terms of the Lease Agreement, and be responsible for any damage. My guarantor will be required to complete an application which will be subject to approval. If a guarantor should be necessary, I agree to provide a qualified guarantor prior to the date I move into the apartment. Time is of the essence. No agreement except contained herein will bind the applicant, agent, or owner. The layout, furnishings and location of the apartment assigned may differ from any model shown. I hereby agree to abide by the entire rental agreement. I hereby authorize Landlord to obtain credit reports and conduct such other investigations of my reputation, character, credit, employment, academic enrollment and performance, other references, and any other information which Landlord deems necessary in connection with this Application and leasing of the apartment to Applicant, which authorization shall continue throughout the term of any lease which is tendered to me. False information given to Landlord shall be grounds for termination of right of occupancy, and rejection of application. I agree to pay for any additional costs that Landlord incurs as a result of processing my Application, such as but not limited to employment verifications, ownership, etc. First months rent is due and payable within two weeks after this application is submitted. If expedited move in is requested (which is less than two weeks after this application is submitted) then first months rent is due and payable at the time this application is submitted. ELECTRONIC SIGNATURES: In accordance with NMSA 1978 14-16-7, each party agrees that the electronic signatures, whether digital or encrypted, of the parties included in this Agreement are intended to authenticate this writing and to have the same force and effect as manual signatures. Electronic signature means any electronic sound, symbol or process attached to or logically associated with a record and executed and adopted by a party with the intent to sign such record, including facsimile or e-mail electronic signatures.
